TERMS AND CONDITIONS OF THE warsawdog.com ONLINE SHOP

§ 1

General provisions

  1. The online store [hereinafter the "Store"] conducts retail sales via the website at warsawdog.com. The sale is conducted on the basis of these regulations [hereinafter "Regulations"], taking into account generally applicable laws.
  2. The owner of the Store is Zofia Kwiatkowska, running a business under the name Warsaw Dog Zofia Kwiatkowska at the following address: ul. Myśliborska 53/210, 03-185 Warszawa, NIP: 5213480050, email address: [email protected].
  3. The prices given in the Store are expressed in Polish currency and are gross prices (including VAT). Product prices do not include the cost of delivery.

§ 2

Orders

  1. Orders in the Store can be placed via the website.
  2. Online orders can be placed 24 hours a day, 7 days a week.
  3. The parties are bound by the information contained on the Store's website next to the purchased goods at the time of placing the order, in particular: price, product characteristics, its features, elements included in the set, date and method of delivery.
  4. When placing an order, the Customer indicates:
    1. your personal data to the extent necessary to perform the order,
    2. ordered goods,
    3. the address to which the ordered goods are to be delivered,
    4. Delivery method,
    5. payment method.
  5. The conclusion of the contract with the customer takes place when the order is accepted by the seller, about which he informs the customer within 72 hours of placing the order by e-mail.
  6. In the case of prepayment, the order is accepted for processing after the Store receives confirmation of payment.
  7. The conclusion of the contract with the consumer takes place at the time of placing the order.
  8. The execution of the Consumer's order payable by bank transfer or via the electronic payment system takes place after the Consumer's payment is credited to the Seller's account.
  9. The customer is obliged to pay the price under the sales contract within 7 days from the date of its conclusion, unless the sales contract provides otherwise. Failure to pay the customer in due time will cancel the order.
  10. Placing an order and its confirmation by the Customer in the manner indicated in paragraph 4 is a legally binding sales contract concluded between the Store and the Customer.
  11. Materials for some accessories are not in our warehouse and we order them only after the customer has placed the order, and the delivery time depends on the supply chain and therefore the time of completing the entire customer order may be extended for objective reasons, beyond our control.
  12. The order fulfillment time is a maximum of 14 business days from the receipt of the payment (prepayment) or from placing the order (payment on delivery). We always try to make the execution time as short as possible, but it depends on the number of orders - orders are processed in real time, after the order is placed by the Consumer.

§ 3

Payments

  1. The customer can choose the payment method:
    1. Transfer - then the Store sends the purchased product to the address indicated by the Customer after the payment is credited to the bank account,
    2. PayPro
    3. Blik
    4. By credit or debit card
    5. PayPal by email [email protected],
    6. Cash on delivery at the courier.
  2. Shipment prices are specified in the delivery price list.

§ 4

Shipment of goods

  1. The ordered goods are sent by the Store via shipping companies (by courier or parcel locker) or made available for collection by the Customer at the Store's premises.
  2. The ordered goods are delivered according to the following delivery times:
    1. by courier within 48 hours,
    2. via Inpost Paczkomaty within 48 hours.
    3. via Poczta Polska - according to the regulations of Poczta Polska, taking into account the delivery zone.
  3. In the case of payment by bank transfer or using a payment card, the deadline for delivery of goods is counted from the date the payment is credited.
  4. Shipping costs available on the website apply to shipping to all countries of the world.

§ 5

Complaints Policy

  1. In the event of non-compliance of the goods with the contract, the Customer should contact the Store's staff by sending an e-mail to the following address [email protected] along with a description of the goods being complained about and its non-compliance with the contract.
  2. The store will respond to the customer's complaint within 14 working days from the moment of returning the goods, together with a description of the non-compliance.
  3. When the implementation of a justified complaint involves sending a new product to the Customer or removing non-compliance, the delivery costs are borne by the Store. Otherwise, the costs of shipments incurred are borne by the Customer.

    § 6

The right to withdraw from the contract

  1. The customer has the right to withdraw from the contract without giving any reason within 14 days of receipt of the goods, as long as the goods have no signs of use.
  2. The customer returns the goods to the Store within 14 days of submitting the declaration of withdrawal from the contract.
  3. Within 14 working days of receiving the package, the Store will check the condition of the delivered product.
  4. Within 14 days of submitting the declaration of withdrawal, the Store returns the amount paid to the Customer. The refund will be made by transfer to the bank account indicated by the Customer.
  5. The right to withdraw from the contract is not available to the customer if the subject of the sales contract are non-prefabricated items, manufactured according to the consumer's specifications or serving to satisfy his individual needs.

    § 7

    Terms of warranty

    1. The warranty period begins on the date of purchase of the product and is 2 years.

    2. The guarantee is valid on the territory of Poland.

    3. The warranty covers manufacturing and material defects of the product.

    4. The warranty does not cover any claims other than those listed in point 3 - in particular: product defects resulting from improper use or use other than intended, improper maintenance, product modifications, damaging dirt (oils, paints, solvents, acids), mechanical damage; wear and tear of materials as a result of normal use, caused by accidental events (fire, moisture, crushing, tearing, cuts, biting, etc.) and damage occurring after contact with salty sea water and humid air.

    5. The warranty is valid only with the proof of purchase of the product, which has a legible date of purchase and the seller's labeling.

    6. The guarantee does not exclude, limit or suspend the rights of the buyer resulting from the non-compliance of the goods with the contract and the law on consumer rights.

    7. The guarantee does not cover claims arising from claims for coverage of losses or lost profits as a result of a defect, even covered by the guarantee.

    8. The Store bears no responsibility for the suitability of the product for specific purposes and for the consequences of their choice and use.

    9. The warranty is discontinued in the case of finding the earlier defect mentioned in point 4 or / and repairs carried out on one's own.

    10. The Store shall bear the responsibility and costs for shipping to the seat of the Warsaw Dog company, unless the complaint does not concern manufacturing and material defects of the product.

    11. After verification of the defect at the seat of Warsaw Dog, the product will be repaired or replaced with a new one; if the same product is unavailable, it will be replaced with a similar one or the customer will be refunded.

    § 8

Privacy protection

  1. The administrator of the customer's personal data is Warsaw Dog Zofia Kwiatkowska, based in Warsaw, ul. Myśliborska 53/210, 03-185 Warsaw.
  2. Personal data provided by the Customer on the website warsawdog.com are processed for the purpose of implementing the sales contract and, with separate consent, may be processed for marketing and promotional purposes, in accordance with the conditions set out in the Act of August 29, 1997 on the protection of personal data (Journal U. No. 101 of 2002, item 926, as amended)
  3. The Customer's personal data will be processed to the extent indicated in the order form.
  4. Providing personal data by the Customer is voluntary, but necessary for the implementation of the sales contract.
  5. The customer has the right to access their data and correct them, request the cessation of their processing, object to their processing and request their removal.
  6. The customer may receive by e-mail, in particular to the e-mail address provided by the customer, marketing or promotional materials, if he agrees.
  7. The customer may at any time revoke consent to receiving marketing or promotional materials sent electronically by sending information about the revocation to the following e-mail address: [email protected].

§ 9

Intellectual property

  1. All names of goods offered for sale by the Store, their descriptions or photos are used for identification purposes and may be legally protected or reserved.

§ 10

Entry into force and changes to the Regulations

  1. The Regulations come into force on the day of publication on the Store's website.
  2. These Regulations may be changed.
  3. Amendments to the Regulations will be published on the Store's website.
  4. Information about changes in the regulations will be sent to the Customer to the e-mail address indicated in the order. Within 14 days from the date of receipt of the message about the amendment to the Regulations, the Customer may submit a declaration of termination of the contract.
  5. In the event of failure to terminate the contract within the period indicated above, the Customer is bound by the provisions of the amended Regulations.

§ 11

Miscellaneous

  1. In matters not covered by the Regulations, generally applicable provisions of law shall apply, in particular the Civil Code and the Act on specific terms of consumer sale and amendment of the Civil Code.
